Clear terms for custom design, manufacture, delivery and installation.

These Terms and Conditions apply to quotations and orders accepted on or after 28 July 2026. Please read them before paying a deposit.

Payment of a deposit constitutes acceptance of the relevant quotation, approved drawings and specifications, and these Terms and Conditions.

Acceptance and validity

This quotation is valid for 30 days. Payment of the deposit constitutes acceptance of the quotation, these Terms and Conditions, and all drawings, dimensions, finishes and specifications approved or supplied before payment.

The client must review all quotation details and drawings carefully before paying the deposit.

Variations and pricing

Client-requested variations or changes to the scope, drawings, specifications, site conditions, engineering or regulatory requirements may result in additional costs and revised timeframes. Material variations require written approval before the affected work proceeds.

Deposits, cancellation and payment

The deposit is non-refundable where the client cancels for reasons not caused by Equine Stable Designs. It secures production capacity and contributes towards design, administration, procurement and project preparation.

If cancellation occurs after custom materials have been ordered or manufacturing has commenced, the client is also responsible for the reasonable costs and losses incurred. Any amount required to be refunded by law will be refunded.

Full payment must be received before delivery, installation or collection unless otherwise agreed in writing. These provisions do not limit any rights under the Australian Consumer Law.

Measurements and approvals

The client is responsible for the accuracy of measurements supplied or approved by them. Equine Stable Designs is not responsible for costs caused by incorrect or incomplete client-supplied measurements, except where Equine Stable Designs knew or reasonably should have known they were incorrect.

Delivery, inspection and storage

Products should be inspected promptly following delivery. Visible transit damage should be photographed and reported within 48 hours where possible, and the products and packaging retained for assessment. This timeframe does not limit any rights that cannot lawfully be excluded.

Reasonable storage fees may apply where completed products cannot be collected, delivered or installed because of a client delay.

Lead times and site access

Lead times are estimates unless expressly guaranteed in writing. Equine Stable Designs is not responsible for delays outside its reasonable control, including supplier, material, weather, transport or regulatory delays.

The client must provide safe, clear and suitable access for delivery and installation. Additional costs may apply where site conditions or access materially differ from the information provided.

Manufacturing tolerances and product changes

Custom-fabricated products are subject to reasonable tolerances appropriate to their size, materials, fabrication method and intended installation. Minor variations that do not materially affect safety, installation, functionality, structural integrity or overall appearance are not defects.

Equine Stable Designs may make minor product or manufacturing changes where these do not materially reduce the agreed appearance, functionality, safety or structural integrity.

Paint and timber

Paint may scratch, chip, fade or mark through transport, installation, environmental exposure, normal use or contact with horses and equipment. Minor touch-ups and ongoing maintenance are the client’s responsibility unless the damage results from defective workmanship.

Timber is a natural product and may vary in colour, grain, texture and appearance. It absorbs and releases moisture and may expand during wetter or more humid conditions and shrink during hotter or drier conditions, including seasonal changes between winter and summer.

Reasonable movement, small gaps, minor checking or slight cupping are not defects where they do not materially affect safety, functionality, structural integrity or overall appearance. This does not apply to excessive warping, buckling or damage caused by defective workmanship, unsuitable materials, inadequate clearances or incorrect installation.

Third-party work, misuse and animals

Equine Stable Designs is not responsible for damage or defects to the extent they are caused by incorrect third-party installation or modification, inadequate maintenance, misuse, neglect, or animal behaviour including kicking, chewing, rubbing or impact.

This does not exclude responsibility for an underlying defect in products or services supplied by Equine Stable Designs.

Defects and consumer guarantees

The client must notify Equine Stable Designs of an alleged defect within a reasonable time, provide available photographs and measurements, take reasonable steps to prevent further damage, and allow a reasonable opportunity for assessment before modification or repair where practicable.

Nothing in these Terms and Conditions excludes, restricts or modifies any right or remedy under the Australian Consumer Law. Depending on the nature and seriousness of an issue, the available remedy may include repair, replacement, refund or another remedy required by law.

Ownership and intellectual property

Products remain the property of Equine Stable Designs until payment has been received in full.

All drawings, designs and intellectual property remain the property of Equine Stable Designs. The client may use project drawings for the original project and provide them to its installer, builder, engineer, certifier or relevant authority, but must not reuse or commercially reproduce them without written consent.

Governing law and disputes

These Terms and Conditions are governed by applicable Australian law and the laws of the state or territory where the products or services are supplied. The parties should first attempt to resolve disputes through good-faith written discussions.
